OFFICIAL RULES for “The Great America Giveaway” Sweepstakes

No purchase or payment of any kind is necessary to enter or win.

A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. AFFIDAVIT OF ELIGIBILITY / RELEASE OF LIABILITY AGREEMENT MAY BE REQUIRED.

1. ELIGIBILITY

The Great America Giveaway (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are twenty-one (21) years of age or older at the time of entry. Employees, officers, and directors of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and those living in the same household of each are not eligible to participate or win. Sweepstakes is void where prohibited by law.

2. SWEEPSTAKES PERIOD

The Sweepstakes begins at 12:00 a.m. Eastern Standard Time (“EST”) on August 22, 2025 and ends at 11:59 p.m. EST on October 15, 2025 (the “Sweepstakes Period”). Entries received before or after the Sweepstakes Period will not be accepted.

3. HOW TO ENTER

There are three (3) ways to enter during the Sweepstakes Period (each action constitutes one (1) entry):
1. Follow @DrinkGreatAmerica on Instagram and like the Sweepstakes post.
2. Post a photo of your favorite Founding Flavor on Instagram, tagging @DrinkGreatAmerica and including the hashtag #GreatAmericaGiveaway.
3. Sign up by scanning the QR Code at participating retail locations or visiting https://slktxt.io/1b88H

Limit: One (1) entry per person per method of entry per day during the Sweepstakes Period. Multiple entrants are not permitted to share the same social media account. Use of any automated system to participate is prohibited and will result in disqualification.

4. PRIZES

One (1) winner will receive one (1) Great America Party Pack consisting of: JBL Bluetooth Speaker, Mini Fridge, Great America Party Swag, and a $100 Visa Gift Card. Approximate Retail Value (“ARV”) of Prize: $500. Prizes are non-transferable and no substitution will be made except at Sponsor’s sole discretion.

5. WINNER SELECTION AND NOTIFICATION

One (1) potential winner will be selected in a random drawing conducted by the Sponsor on or about October 20^th, 2025 from among all eligible entries received during the Sweepstakes Period. Potential winner will be notified via direct message on Instagram or via email, at Sponsor’s discretion, and will be required to respond within forty-eight (48) hours of notification. If a potential winner does not respond within the required timeframe, fails to comply with these Official Rules, or prize notification is returned as undeliverable, the prize will be forfeited and an alternate winner may be selected.

6. PUBLICITY

Except where prohibited by law, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions, biographical information, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

7. GENERAL CONDITIONS

Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes, or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

8. RELEASE AND LIMITATIONS OF LIABILITY

By participating in this Sweepstakes, entrants agree to release and hold harmless Sponsor, Instagram, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize. Entrant agrees that Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind; (c) unauthorized human intervention in any part of the entry process; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize.

9. DISPUTES

Except where prohibited, entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Utah. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Utah, without giving effect to any choice of law or conflict of law rules (whether of the State of Utah or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Utah.

10. PRIVACY

Information collected from entrants is subject to Sponsor’s privacy policy and will be used for the purpose of administering this Sweepstakes and for marketing purposes. By entering, entrants consent to receive email communications from Sponsor.

11. WINNER INFORMATION
